This book radically reforms the classical paradigm of international law by proposing novel theoretical frameworks as constitutional pillars of ‘a globalised democratic society’. The book applies these to examine the interactions between human rights treaty organs, including the European Court of Human Rights and the UN Human Rights Committee. The discussion extends to state organs such as parliaments, courts, and national human rights. In so doing, it offers the first comprehensive theoretical framework underpinning the functioning of human rights in the reality of globalised society, and not (as traditionally is the case), separate on the international and state level.
